Trading Period
The class action was brought by the Applicant on its own behalf and on behalf of all persons who acquired ordinary shares in Myer:
- on or after 11 September 2014; and
- who held any of those shares at the commencement of trading on 19 March 2015 (“the relevant period”).
Issue of Statement of Claim
On 29 December 2016 the statement of claim was filed by Portfolio Law on behalf of the Applicant.
Myer’s Defence
On 14 February 2017 Myer filed its defence to the statement of claim filed and served by the Applicant.
Lodgement of Security for Costs
On 20 April 2017 the Court ordered the Applicant provide security for the Respondent’s costs. The sum of $322,459.77 was paid into Court.
On 29 August 2017 a further sum of $700,000 was paid into Court. This sum was paid as security for the Respondent’s costs for the period of 3 June 2017 to 16 March 2018.
Expert Evidence
By 14 February 2018 the Respondent must have filed and served their expert evidence upon which it intends to rely at the initial trial.
By 14 March 2018 the Applicant must have filed and served all expert evidence in reply upon which it intends to rely at the initial trial.
Case Management Hearing
On 1 June 2018 there will be a case management hearing.
Mediation
By 18 May 2018 parties must have completed a mediation.
Trial
On 6 August 2018 there will be an initial trial which will run for approximately 3 weeks.
